Public Intoxication, but on My Way Home in a Cab

My question involves criminal law for the state of: California

I was recently was arrested for drunk in public but was pulled out of a cab about a block and half away from where I was picked up. Police are claiming I said, "F*** the police" and pulled me out of the cab and arrested me for drunk in public. It was 2:00AM and everyone was getting out of the bars and a fight just broke out and when I was on my way home. I was drunk but was clearly okay to put myself in a cab to get home.

The state must show that you had consumed drugs or alcohol and you were unable to care for your own safety or the safety of others. That burden can be met as a result of your actions or as a result of your inability to walk or talk straight. Whether they can meet that burden or not none of us can say.
