My question involves employment and labor law for the state of: FLORIDA
My wife was an IC working without benefits. She is now pregnant and the employer elected to bring her on as a part-time employee and provide her health insurance benefits. To do so they explained that they had to make the change "budget neutral" and so they have made her responsible for paying all of her FICA. When she first mentioned this to me I didn't feel that it was legal but wasn't sure. So can the employer who is offering benefits force her to pay her whole FICA (15.3%)?
