    Default Tracking overtime through badge swipes

    I have been trying for the past 3 years to get a clear and concise answer to the age old "Am I eligible for overtime even though Im salaried?"question.

    Well today I got the answer I was looking for....YES I am eligible.

    Now the question is...how do I go about calculating the number of hours that I worked?

    My employer said that they are able to take the times that I scanned my badge to leave and enter the building, but I dont think that is right seeing that sometimes the system does not work and sometimes the gates are already open.

    Also, my employer is saying that by law the company only has to award 2 yrs of back overtime pay. Seeing that I has been over three years since I have first began the inquiry into the overtime question and only now since we have a new human resourse manager that I have gotten a straight answer, I feel that I should be compensated back to the time I initially inquired about my ovetime status.

    Not sure what to do.....

    Default Wage and Hour Issue

    If your employer has time records from your badge scans, showing the hours you were at work, that seems like a pretty good way to estimate your hours. You could deal with days when you worked but didn't scan in, out, or at all, on a case-by-case basis. It's difficult to know what alternatives are available - can you think of a better way to document your hours?

    You may wish to discuss your situation with a local lawyer who handles wage and hour claims.

    Thanks for the advise. Any insight on the issue of going back more than 2 years?

    Default Two years of back wages

    That will likely depend upon the governing statute of limitations, state and/or federal.
