    Default How Long Do I Need to Keep My Ex Girlfriend Stuff

    My question involves a child custody case from the State of: NJ

    My girlfriend of five years just left me last Monday. We have lived together the whole time. I have not seen my son since last Monday. She is refusing saying she is waiting for us to go to meditation.. I have retained an attorney and he is filing for temporary custody for myself on Monday.
    What are her rights so far as the apartment goes. She told me she was coming to get some of her stuff. I said fine fine let me know a time. she said she didn't have to it's still her apartment, her name is on the lease. She said she didn't move out. How long do I have to keep her stuff there and can I change the locks. She also refuses to give me the key back. She plans on coming back and forth only for the clothes she needs for herself and my son thinking its a revolving door. What can I do,

    No, you cannot change the locks. She is on the lease and until that changes, she has as much right to come and go as she pleases as you do.

    Who has been your son's primary caregiver? (I don't mean financially - I mean in terms of day-to-day caregiving).

    meditation is good for the soul but I doubt it will help in your legal situation.

    Oh, her name too. That means it is her apartment as well as yours. She can come and go as she pleases and can store whatever she wants to store there for as long as she is a tenant.

    How long do I have to keep her stuff there and can I change the locks.
    You can do neither until she is no longer a tenant.

    She also refuses to give me the key back.
    She has no obligation to give you her key to her apartment.

    She plans on coming back and forth only for the clothes she needs for herself and my son thinking its a revolving door.

    There is no lease. We are on month to month. I really can't say who has been the primary caregiver. She's there while I worl but doesn't do anything. She doesn't cook, clean or basically anything. I come home and have to cook and clean and take care of my son I mean, bathing feeding, etc. She watches tv all dayy and talks on the phone. The phone records can be verified. She can talk an average 6 to 7 hours during the day while I am gone

    In the eyes of the court, she's the primary caregiver.

    I'm sorry - but that's likely going to remain the case unless there's a question of fitness. (And there's not, evidently)

    How about: there is no definite term lease.

    I'll make is simpler:

    is there any contract signed regarding renting the apartment? Is her name on it as a tenant?

    If so, until that changes, she is a tenant of the apartment.


    If you want to do anything, you would first have to terminate your rental agreement with your landlord. Then you can enter a rental agreement without your ex. That should give her a month or two to deal with the issues during which you cannot do anything to her property.
