My ex-husband was deported back in 2001 for statutory burglary and was barred for 5 years. He returned illegally last year and was caught a month ago trying to get a driver's license with a fake SSN (with his own original SSN number). Now he is trying to fight his immigration case claiming his life is in danger if he goes back to his native El Salvador. He has 2 kids with me here (both children US citizens) and one child with another women (also an illegal with a US citizen child). My question is what are his chances of being granted the hardship waiver? Will the charge of using fraudulent identification hurt him? Will having children here help him? It didn't help us before when he originally got deported.
