    Exclamation Probation Officer Not Aware of Arrest

    My question involves criminal law for the state of: New Mexico

    My boyfriend was arrested on Thursday night because of a probation violation by his trackers when they came to do a routine check at his house and found an empty can of beer. His friend was drinking. My boyfriend was not drinking though. I've been trying to find out what the situation is, but I wasn't successful. I thought he would see a judge today, but he didn't. Then today I was just researching online and by sheer luck I happened to find out who is probation officer was. I decided to call him to see what I could find out; turns out he didn't know he was in custody. He took my information and said he'd find out what's going on, but he'd have to get my boyfriend's permission first, understandable. Is is a good thing that his PO is now aware of the situation? can his PO help him? What will happen at this point?

    Okay? But is he on probation or parole. He has an officer right? Is it a parole or probation officer?

    Well, he will be violated for possession of the alcoholic beverage. His house, his issue. His friends should know better than to set him up like that. He's going to sit until his hearing date. Depending on the original offense, it could be grounds for revocation of probation.

    You calling and informing his PO didn't hurt, but it didn't help either. If he found out that you called in his violation, he could really pissed at you for snitching. I suggest that you don't call his PO unless he is a danger to you or someone else. You getting in his business can backfire on you.

    It seemed that his PO is the one who has really been helping him. He was supposed to serve 3 years in prison. He was able to get him 12 months probation and 6 months parole.

    His trackers were pushing for him to serve the rest of his term in prison for his violation. Don't think it could have made it any worse. But since the PO was not notified of his arrest I've heard that this would work in his favor. Since his PO seems to be trying to help, would that be a possibility?

    His original offense was battery on a peace officer

    It's his case. Trust me, you should not be calling his PO. It does not always work in the defendant's favor.
