    Default My probation was completed as a HYTA

    Last year I was in arrested in michigan as an accesory to Home invasion and larscony in a building. I did not actually commit the crime, this person i dropped off comitted the crime and i was seen letting him out of the vehicle. after exiting my vehicle he decided to steel pop bottles from a garage that was connected to a house. The home owner was awake and the invader was arrested immediatly. I was arrested after the home owner said he say the perp get out of my car and the perp told them he was indeed droped of by me. so i went to jail and sat in county for 37days till trial. the home invasion was dropped. they wanted me to plead guilty but i continued to hold out, I did not want to plead guilty but i had no other choice my lawyer was court appointed and didnt act like she had any intention on fighting the case. so i pleaded guilty.anyways abunch of people wrote letters to the judge on behalf of my charecter. I mean charitys that i volunter for, neighbors, family members, demolay advisors, teachers at college, employers and former employers, people who know me from church all wrote letters on my behalf to attest to my character. I even had a friend who is a lawyer take my case for free, but the court appointed attorney wouldnt answer his phone call and the court wouldnt let him take the case because itwas to late to do so or something. But my lawyer friend informed me that my court appointed lawyer didnt do anywork on my case or anything; she didnt make any motions on my behalf( which he said there was at lest a dozen that should have been made) so he advised me to plea guilty. so I did and the judge sentenced me to probation and added a stipulation that if i complete my probation without any violations my case could be closed as a HYTA. I completed without any violations and was completed as a hyta. I then recieved a envelope in the mail containing three pink peices of paper; one was a "Motion and Order for Discharge From Probation", the second was a "Motion and Order for Return Of Fingerprints, arrest card and discription"; the third was a "Order of Acquital/Dismissal or remand"


    the Motion and order for Discharge from probation form states that the probation was succesfully completed and it had box four checked which said " The status of Youthful Trainee is terminated under the Holmes youthful trainee act (Mcl 762.14) and the case is dismissed"

    it was signed by a judge

    the Motion and Order for Return Of Fingerprints, arrest card and discription
    says "it is ordered Under Mcl 28.243 that the state police and arresting agency shall provide the defendant with a certification that the fingerprints, arrest card, and description were destroyed(if so) or immediately, with out charge adn without further demand, return to the defendand/Juvenile the finger prints, arrest card, and description taken or made in the above case.

    it was signed by a judge

    the Order of Acquital/Dismissal or remand form does not have any boxs check and yet does say that the case is dismissed on the motion of the court WITH Prejudice. the bottom of the form says that my finger prints, arrest card, and discription are to be destroyed or returned to me within 60 days of the date of this order.

    it was signed by a judge



    My question to you is what does all this mean?
    i tried reading the laws and it is confusing.
    one more thing i would like to add is i am 24 years old does this all still apply to me or did the judge just waste his time filling out this paper work, am i just getting my hopes up for nothing( thinking that my record is clear and that i am closed as a hyta) or does this all really help me and how?

    oh yeah do you also think it wise to copy these forms in digital form as a Jpeg, as well as make additional paper copies, and save them as well as the originals in seperate locations just in case.

    Contact your lawyer friend and ask them for their assistance.

    It is your choice as to how you save copies of the forms, contact your lawyer friend to answer your questions. In the future, be careful who you give rides to.
