    Cool Cops on My Rental Property

    My question involves landlord-tenant law in the State of: utah
    Ok here is what keeps happening i am renting a house straight across the street from a bar and the cops seem to think that it is ok to sit in one of the properties drive ways and right of ways. Is this legal because i always thought that they had to sit on public land not private? They also pull over every single car that leaves the bar which i think is a bunch of bull shit because i no a couple of vehicle i have watched get pulled over that have sober drivers is this legal to pull over every car that leaves the bar? When the cops are sittting on the rental property can i ask them to leave? Is it legal to pull over every vehical that leaves the bar? Please help me because i am getting sick of the cops over stepping ther bounds (or at least what i think there bounds are). I think that there are some major laws getting borke by ther cops in this case because im sure that the renters of this property have not given the cops permission to sit on the property please give me advice!!!

    There is nothing unlawful about their presence in the driveway.

    Now, if you do not want them parking in your driveway, you can ask them to please stop. If they continue, you can report it to their supervisors. So long as your neighbor does not oppose their presence, they will probably continue to park there.

    Legally, they require reasonable suspicion to detain a driver and vehicle. Since you are not in either the police car or the vehicle stopped, you cannot possibly know whether this reasonable suspicion can be articulated or not. If they truly are pulling over vehicles without good cause, then they are breaking the law. You are certainly free to report these observations to the agency, the media, or anyone else you please should you wish to do so. Until one of those drivers complains, and it can be shown that no reasonable suspicion for a detention existed, then the practice may veruy well continue.

    When the cops are sittting on the rental property can i ask them to leave? Is it legal to pull over every vehical that leaves the bar?
    Yes ... and, maybe - if there is reasonable suspicion to affect the detention.

    actually, if they park in your drive after you have told them they are not allowed to do so (presuming the same officers anyway), you can seek trespassing charges against them. Same for the other renters. They are not allowed to continue to enter the property once given notice they are not allowed there.

    as to the cops pulling every car over: that is something those detained would have to contest. As Carl stated, they need reasonable suspicion to detain the drivers. Whether there is such reasonable suspicion is something each individual driver would have to contest and argue.

    as to what you are describing as a ROW: depending on what the ROW is for, this action may very well be completely legal.

    I observed these officers last night and i also noticed one other thing that i found to be very disturbing. The mexican americans that were in the bar were pulled over almost instantly when they left the bar. When the white people left they were followed for some distance before they were pulled over. i do belive these officers in this town are very bad racial profilers which irratates me greatly. Is there anything i can do about this because they are harrasing the customers at this bar so bad every night the owner is loosing most of his buisness.

    as stated previously;

    you have no standing to do anything official. You can report your beliefs to anybody that will listen including the bar owner, the patrons, the media, and the police administration. Other than that, if anybody wants to do anything, it would have to be somebody that is affected by the situation.

    At night, from across the street, you can tell the race of the people inside of a car? That's impressive. I can't.

    Understand that it does not take a lot to justify a traffic stop. The rules that drivers must abide by are many, and the chances are pretty good that a driver will not adhere to all of them when they operate their car.

    But, as mentioned previously, you can complain to whomever you wish but you have no legal standing to do much else.
