I was already 2 months pregnant when my ex and I got together, he was aware and told me that he wanted to take on the responsibility of being my child's father. He was very controlling and mentally abusive, so I got away from him. He doesn't want anything to do with my son and wants his name off the birth certificate because he is not "his child". My son is only 3 months old and I heard that I can deny paternity and get his name removed from my child's birth certificate without involving the court before he turned 1. Is it true? And would I have to put down the biological father instead? The biological father is actually in prison and left me stranded in AL when he found out I was pregnant. I also want my son to have my maiden name.
