    Default Avoiding Deportation

    My fiancee is awaiting some federal charges to be dropped due to he was falsely accused but we are afraid that he might be processed for deportation. How can we avoid this ?? Should we star his immigration process now ? He does have a US citizen son, and of course I am one too and want to work on hhis legal. statuse, Any advice ???

    Well his ex accused him of kidnap n he has assult, his court date is coming up but she has agreed to drop the charges she placed since she did agree they where lies ....

    What is his IMMIGRATION STATUS. Is he here legally? What visa did he come in. Is he still within the term or has he overstayed?

    He should be working with both a criminal defense lawyer and an immigration lawyer, or at least a criminal defense lawyer who is very familiar with immigration laws. The fact that his ex- now wants to drop the charges does not mean that they will, in fact, be dropped; and even if they are dropped it does not mean that the USCIS will determine them to have been without merit. If he's deported for kidnapping, I do not expect that he'll ever be allowed back into the U.S.A.

    Not even if there proof its not true, witnesses and all ? The situation started cause he has proof she was cheating, so when they arrested him she took the kid to another state, will any of this help in the case ? Even if she admits she lied? He does have a criminal lawyer, so we should start working on immigration?
