    Default DUI and Traffic Violation on Probation

    (Edit: this is for a traffic violation on Probation from DUI, looking at the title makes it seem like I got a DUI on probation, not the case, sorry for any mix up)

    My question involves criminal law for the state of: Georgia

    Hello all, im sure there are a bunch of these posts, but searching through all of them brings up so many different answers, none of which are specific to me. This is also for the state of Georgia in Cobb county.



    But I had a question about being on probaiton and receiving a traffic violation. I was sentenced to a DUI charge in May, and was sentenced to a 1 year probation and 1 year license suspension. That suspension can be reduced to 4 mounts if I take the DUI/risk reduciton class, which I have done. My probation is bascially where I dont have to call in or show up at the office to do an interview or anyhting, I just have to mail in my letter every month stating what I have done, if I have recieved any violations, stuff like that. All fines have been payed, all classes have been completed, I pay my P.O. officer in 4 month increments, and I am currently working on my community service and nearing completion. I was going to turn in all my hours once completed, but I am going to go ahead and turn some of those in to show that I am working on my hours.

    But the other day driving home from work. (I have a limited permit which allows me to go to school and work). When I came up to an intersetion where there was an accident, To make a story short, because of the way the officer was directing traffic and the flash light he was using and shinning in my windshield, I was unable to see his hand gestures, and continued in the line of cars, when I did see him I stopped and he told me to pull to the side, after all is said an done, I receive a ticket for failre to obey person directing traffic. Seeing as Im not that far into my probation, but have almost everything done and would be going onto non-reporting, what will happen when it comes time to go to court. I will be pleading not guilty to this charge, but not sure how this will pan out, whether I would have to go to jail over it or not. My suspensio for my license (from the 4 months) would be up in less than a week, so not sure what that affects either.

    Was just curious as to what may or may not happen.

    Report it to the probation office. This shouldn't be a big deal provided you were within your driving restrictions and sober.
    In fact, I'd make a stab at defending it in yourself in court on the new charge.

    I did report it to the probation office, but was only able to leave a voicemail, I am still trying to get ahold of them though, but its definitely something I am going to fight, just wasnt sure what would happen if the worse were to happen.
