    Question Establishing Husband's Nonpaternity so Boyfriend Can Go on the Birth Certificate

    I am currently pregnant and due in 2.5 months. I recieved a paper at my last check up (standard hand out) stating that if a mother is married, and has a child with someone other than the husband, either the husbands last name must go on the certificate, or a paternity acknowledgment must be signed by both the Husband and Biological father, AT THE BIRTH?, theres even a place on the form that I looked up online for a nurse to sign as a witness.

    After having said that, heres my story.

    My husband and I have been split up, but not divorced since the end of '10. He moved back home to Las Vegas in January this year. I still live in Louisiana. I met and started dating my now boyfriend, and after 3 months of dating, I became pregnant. I know for a fact there is no way possible my baby is with my ex, unless I'm 14 months pregnant right now lol. We all know that my current boyfriend is the father, but how in the world are we supposed to sign a paper, all three of us, at the hospital, when my ex lives in Las Vegas? Did I misread the paper work, or is this accurate? Is there a different form or way to go about it since my husband lives 1500 miles away? Also, worst case scenario and theres not a way to get my boyfriend as the father on the birth certificate, can I at least give the baby my maiden name? I absolutely DO NOT want my husband on the birth certificate at all, it would tear my boyfriend up to see his child's father legally being my ex. Not to mention the can of legal worms that opens up, that I would have to deal with later down the road.

    Yes, you're reading it a bit wrong

    All your husband has to do is sign HIS statement in front of notary where HE lives, and mail it back to you. THEN you submit that, with yours and your boyfriend's affidavits.

    You should be able to use this form

    So send it to him first, and he can sign and have it notarized correctly and mail it back to you.

    Ok thank you very much. One more question... Under the Husband/ex-husband section, where my ex would sign, it says Father's Signature? Shouldnt it say husband/ex-husbands signature?
