My question involves criminal law for the state of: CALIFORNIA
Background: Was a resident of CA in up to 2010. I have a DUI convection in Orange County CA in 2006. By 2009 I completed the terms of both the DMV and criminal penalties. My CA License was reinstated. In 2010 I got a job in Arizona and - by AZ law -obtained a valid Arizona Drivers License because AZ was by then my permanent residence.
Situation: In May of 2011, while still on the summary probation for the 2006 DUI, I was pulled over in California and found to have a BAC of 0.02 while driving - a violation of summary probation. I received a ticket that states it is an infraction under S 23154. I was not arrested but rather cited, got temporary CALIFORNA (not AZ) driver's license with 10 days to notify CA DMV for hearing.
MY QUESTIONs:
1) Even though I produced to the officer my valid Arizona Driver's License containing my current address, the officer wrote on the ticket my old CALIFORNIA License number. I surrendered my CA license to Arizona MVD *way back* when I got my Arizona Driver's License. Is this illegal and were my rights violated?
2) Will California DMV require completion of a 18 Month Alcohol program for my AZ driver's Lic? What will the CA DMV require?
3) What do the courts and DMV usually impose in such 23154 violations? the county is orange county, ca.
