I am a new owner of a rental property that had a difficult closing which resulted in the former owner giving me the wrong keys to the rental property. I live in Central New York. The 2nd floor tenant received no notice to vacate as he was in process of moving out at the May 9th closing. He became difficult and locked access to the cellar which is from his front hallway entrance. State Trooper responded to my call and advised tenant to not deny access to cellar and tanant complied, telling the trooper he'll be out at the end of the month. The trooper looked around the apartment and told me that there was nothing there except a few boxes. The tenant he has disconnected all utilities except cable, turned off service to his telephone as of last Thursday. He still has belongings in the front hallway and possibly inside (even the curtains are removed from the windows). He will not contact me and his lease expires at midnight tonight (May 31, 2005). He has two kids ages 8 & 10 and he is no longer sleeping at the apartment, though reappears for a short time each day. Can I legally enter the premises by noon of June 1, 2005 if he has not left the keys or contacted me???????? What is my right in this issue??? Thank you for any help with this.
