I know that this forum is for American law, but I thought I would post my question in the hopes that someone would know. My question is in regards to Canadian law. If a person was caught shoplifting under $50 and the RCMP was called and the RCMP officer handcuffs you and places you in his/her car for a few moments and then states that he is dropping the charges against you, after which he said you were free to go. Thus you were never asked to appear before a court and you were never fingerprinted nor were you photographed and there was no fine placed, will you have a criminal record? Would this situation show up under a USCIS background check which involves an FBI Fingerprint and Name Check and an IBIS Name Check?
