    Default H1-B and Green Card

    I just received the approval notice for H1-B which is going to start in October, 2005. When is the earliest time that I can start the application for an employer sponsored green card?

    The employer should be able to file for an alien worker to become a permanent resident in the United States once the employer receives an approved labor certification.

    O.K., but do you know when I can start applying? I mean, do I have to first finish my three years on the H1-B visa or I can start applying let's say, maybe a few months after starting the H1-B.

    Default Employer Filing for Green Card

    If you are still talking about an employer-sponsored green card, your employer may apply for the green card once your employer receives an approved labor certification. You do not apply for an employer-sponsored green card - your employer applies.

    Default H-1B to Green Card

    Your company may file for Labor Certification even before you start working on your H-1B, since H-1B allows a dual intent.
