    Default Hit a Car With No Lights On, Driving Without Insurance

    My question involves an injury that occurred in the state of: Arizona
    iwas in an accident yesterday. the other driver had stopped her car in the road way, pulled her ememgency brake & got out of the car to get a dog that was running lose. She had No lights on at all. By the time I realized the car was not moving, I hit her car. She was not in the car, but neither her nor her passanger, still in the car, was not injuried. I on the other hand do have minior injuries from my air bags deploying. The officer said he was leanning toward it being the other drivers fault since she was obstructing the road way which she did admit too. However, at the time of the crash I had no insurance. I did get it later that same day though. I was not sited there was told by the officer to call with the policy number later. not sur where to go from here. need help!

    Officers opinions on fault have no bearing on insurance companies. Sometimes the fact that one driver is charged and the other is not will sway that decision but that is it.
    Getting insurance "later" isn't going to help you. Were you cited for no insurance?

    More than likely you will not get any reimbursement from the other driver's insurance.
    It's quite possible they will try to come after you for slamming into them. If you were covered by insurance, they'd defend you. As it is, you are on your own.

    No. I was not sited for no insurance. officer said he was leanning with it being her fault for obstructing a roadway. even if it's proven she's at fault? which she did admitt to at the scene. even if its proved she's at fault can the her insurance deny claims for damages? I guess i need see what the report says & go from there & start looking to possibly getting a lawyer if im going to have to fight this. Hoping for the best in this!

    I will say that in most cases... the person hitting a stationary vehicle is the one at fault.... even if.

    You getting insurance after an accident is worthless.

    she should definitely have been cited for a couple violations but even with those violations, you are also at fault for failing to not hit a stationary object. It would appear you were driving too fast to be able to stop within an assured distance which is the real cause of the accident.

    Neither the police nor the insurance companies can determine fault. They can both speak to the issue and make their beliefs known but ultimately, if there is a dispute to cause, a court will be required to determine who is at fault.
