    Default Tenant Always Pays Late

    My question involves landlord-tenant law in the State of: Pennsylvania

    We have a rental. The tenent is always, every month late with the rent. He pays half on the first and half on/about the fifteenth. The whole amount is due on the first.

    Now, since he went on vacation this summer, he has fallen even further behind - the half we get on the first is actually the second half from the previous month, and the half on the fifteenth is the rent that was due on the first, etc. This tenent cannot manage his money, if he has a dime, he spends a quarter type. He will never get caught up.

    This is a month to month rental agreement.

    Can we take his back rent out of his security deposit to get him caught up?

    We are a little hesitant about eviction, this guy is a former coworker of my husbands and they are taking good care of the property.

    I really appreciate any advice!

    If you choose to renegotiate your lease to eliminate part or all of his security deposit, you will be in the position of having a tenant with a smaller or no security deposit. And how long do you think it will take before you're in the same position, but with no security deposit.

    If you don't want to evict him, you are going to have to live with the fact that he pays rent late. When his lease is up you can consider bumping up his rent (consistent with any state laws or local ordinances governing rent increases).
