    Exclamation Can You Lose Your License Over Misdemeanor Reckless Driving

    My question involves a traffic ticket from the state of: Florida.

    How do I avoid losing my license due to a misdemeanor reckless driving charge? I was charged last month with a misdemeanor reckless driving offence in the state of Florida. I am 17 years old and have had absolutely no prior convictions for any other traffic offence. The police pulled me over on Interstate 10 because someone called in to the Florida Highway Patrol hotline stating that a vehicle matching my description was erratically passing and flashing the high beams, something I did not do. The police pulled me over and wrote me the citation not because they had actually seen me commit the offence, but because my vehicle matched the description in the report, meaning the cop didn't see me do anything wrong. If I lose my license, I will not be able to go to work or school, and will be unable to drive my disabled father to his client's offices. Can someone please help me? My court date is in just a few days, and I'm incredibly worried. Kudos to any response, thank you so much!

    Hope the witness doesn't show. If the witness does, ask how they knew it was you.

    Unless he has proof though, how would they be able to convict me?

    A witness testimony IS proof.

    Granted, not great proof, but proof.

    So, that being said, what should I say to the judge, whether or not the witness shows up. Once again, please keep in mind that I did not commit the offence I am accused of.

    If the witness shows, and testifies to your behavior, you have little you can do in your own behalf. You'd need a lawyer.
    If there is no witness, you will point out that you were not flashing your lights and driving erratically and any testimony from an officer that says that someone else reported it is hearsay (this is one of the few times that people want to claim something is hearsay and it actually is).

    I would suggest working with your lawyer to get a copy of the 911 call.

    When you say "matching my vehicle", do you mean simply "make and model", or did they also report your license plate number?
