    Default Landlord Sold House to New Landord

    Hi, I am really worried and scared, I just got a 1 bedroom apt and signed a lease for 4years for june 1st. The landlord sold the building a few weeks after we gave him the first month a nd security. The new landlord is plotting to evict all tenants who live in this private house. I was told that the lease is not in effect until 30days after my move in date. I was neer told about this and am so scared. I even painted the apt myself with my own money, its not fair please help me, is this the law or is this wrong. my name is richie

    Default Problems with Lease

    Without reading the lease, I am not sure whether the new owner has any basis to terminate the lease, why it would commence thirty days after your move-in date, or what remedies you might have. Also, your rights and remedies will vary by state and, to some degree, by locality. You may wish to consult with a local landlord-tenant lawyer or, if your means are limited, a legal aid office. (Some state bars offer referrals to attorneys who provide consultation to people of limited means.)

    I had a meeting with him today, where he had stated 30 days was not true. I had read the lease and it states the landlord only had 3 days to terminate the contract with me, but it was past 3 days, and he felt really stupid, he seems to be trying every and anything to get me out but i came today with my mom and stated that i would fight it in court before i leavce the residence so he took a big step back and is thinking what he should do. I am now in the process of looking for an attorney that I can ask simple questions on what to do and can i take it to court and would i win under these circumstatnces. The lease also states that the second all parties sign the binding document that it is in effect.

    Default Buy-Out of Leasehold

    If your landlord really wants you out of a four year lease, he may be stuck offering a buy-out.

    What you are saying makes sense now. But i would like to know am I legally able to stay in the house though we are at different sides of the pole, if you know what i mean.

    Default Lease

    You say you have a valid lease. You presumably have not broken your lease. So you should be able to enforce your lease.

    He even tried to get me to move in a little earlier, but I new what he was trying to do which was set me up for a breach of contract. I was just wondering if this is true that because I am renting a apartment in a private house that the lease contract is not valid and can be broken if the landlord sells, or is that a mistake.

    If you are within New York City, you should have relatively ready access to various tenants unions and similar organizations who can assist you, generally for free, as to your rights. They may also be able to answer questions about rentals in nearby communities. For specific advice about a specific situation, you should consult a local lawyer.
