    Default Considering Relocating to Different State; Currently Live in Different States

    My question involves a child custody case from the State of: IL
    My children, whom I have full custody of, and I live in Illinois; my ex-husband lives in Wisconsin. In 2008, a child support order was entered in Illinois. My ex made a handful of payments and was then incarcerated in early 2009. Upon release in early 2011 he moved to Wisconsin. He has had little interaction with our children since late 2007 and is supposedly going to start paying child support again (the order has been modified and his current employer should be notified soon). I have been seeking employment in Iowa (1-2 hours from our current residence in Illinois) and am considering relocating. From what I understand, Illinois law requires approval from the non-custodial parent. Has anyone had experience with this? I believe he will sign off on the move if needed, but will this require retaining a lawyer again and going to court first?

    Does your custody order say anything regarding relocation? That should tell you what, if anything, you need to do to relocate. Some court orders prohibit relocation while others simply require 30 days advance written notice of your intent (that allows the other party the option to object).

    No, it doesn't. The only thing regarding any kind of relocation is about the house, that I was awarded. I must move if co-habitating with a new partner or when my children turn 18.

    Then it sounds as though you are free to relocate if you so choose. However, just to be fair (i.e. ensure full CYA), you may want to go ahead and give your ex 30 days advance written notice.

    Sounds like you were only awarded possession of the house until the children turn 18 or you cohabitate. Which likely means you do not really own the house and that it may revert back to your ex, or sold to split any equity in it. If so, your ex may be ok with you moving out early...
