    Default Resetting Statute of Limitations in Texas

    My question involves collection proceedings in the State of: Texas

    Hi, I have a debt which the SOL is expired. My question is this... on this account I listed a dispute on my credit report. Now due to new underwriting laws no mortgage or refinance can be given final approval if a dispute exists on credit report.

    Will requesting that dispute be removed from credit report restart the SOL? Would that be considered an acknowledgment of the justness of a claim in writing?

    I want to close on my refinance but don't want to restart the SOL on this account.

    Nothing you do to the credit reporting agency has any affect on SOL.
    You would have to affirm something with the lender.

    would the credit reporting agency forwarding my request to have the dispute removed to the lender be an acknowledgement of the debt?

    No even if the told the lender it wouldn't reopen the SOL.

    1. The dispute is between you and the agency, that you're not disputing it with them doesn't mean you are not disputing it with the lender.
    2. The fact that you believe the debt was valid as stated doesn't change the fact that it was time barred now.
    3. You'd need to acknowledge the debt exists now (either by explicitly saying that or by making a payment).

    would the wording listed below reset the clock on SOL by acknowledgement of debt? This would only be sent to the credit reporting agencies not the collection agency. however, the credit agencies would most likely forward to collection agency.

    "I am not disputing and no longer wish to dispute the account.

    I agree with the current status and payment history of the account.

    I request all dispute wording be removed from the account.

    I do not wish to have account removed only the consumer disputes notation."
