    Default Probation Authority

    My question involves criminal law for the state of: New York

    A friend of mine's son has been skipping school for a while now, he was put on a P.I.N.S petition by the school. He has had the petition put on him twice and continues to cut, so he was taken to court for first appearance and was put on 1 year probation. My friend wanted to know if this means he is required to submit to drug tests even though he has no history of drug use, and his parent/guardian didn't ask for it.

    You have to look at the court order. If it is stipulated, he must comply. If the order states that the PO can use discretion, he has to comply. If the parent is concerned and wants to add the condition, he/she or bothcan request the add on. Considering his current behavior, the parents should welcome that condition.
