    Default Forced to Take a Specific Job

    My question involves criminal law for the state of: ID
    My nephew is on probation in Idaho for theft. My cousin owns a business in Ohio that would like to hire him. My cousin and nephew have been working with Vocational Rehabilitation and his Probation officer for months and Voc Rehab has even issued the check for my nephew to move to Ohio.This is not just a job, but a career opportunity. At the last minute the probation Officer has decided that it would be better for my nephew to stay in Idaho and work for one of the PO's friends at an auto body shop and rent and live in an RV and my nephew will have to pay for propane to heat the RV (in Idaho in winter) that the owner of the body shop has. The owner of the body shop gets a 9,000.00 a year tax break for hiring my nephew and Voc Rehab will pay for part of my nephews pay. The job pays $8.00 an hour with no guarantees on the amount of hours per week he will work. His probation fees are 110.00 a month, child support is 250.00 a month, rent for the RV is 275.00 a month, approximate cost of propane for 30 days is 245.00 a month. By the time he pays all of that he has 84.00 left a month and has not bought gas to get back and forth to work nor has he bought groceries. Not paying for almost any of the above results in a probation violation.
    The job in Ohio pays 10.00 an hour, 40 hours a week, company vehicle, company cell phone and he can live with me ( I am the aunt), and has family support.
    I believe he is being set up for failure and the auto body shop is going to reap the rewards. Is there any legal course my nephew can take?

    He can request a transfer, but the probation office will have an opportunity to challenge it.

    He did request a transfer and everything was set to go. He needed 600.00 to transfer to Ohio. 100.00 for the filing of paperwork, but would not say what the other 500.00 was for. Voc Rehab and my cousin put in several calls to the probation officer to inquire as to what the 500.00 was for, but the PO would not return phone calls. I called IDOC and asked what the 500.00 was for so that my cousin could send the money. IDOC advised me that the 500.00 was for a bond of sorts to help defray the cost of extradition if my nephew were to get into trouble in Ohio and had to be sent back to Idaho. My cousin had no problem then with sending the money. My nephew had a scheduled meeting with his PO and advised the PO that our cousin was going to send the money. That is when the PO stated that he couldn't go he wanted him to stay there and work for his friend.

    Okay... I would definitely find out the name of the PO's supervisor and talk to him/her about the situation.

    This doesn't smell right.

    I did speak with IDOC about this, they contacted his PO and the PO told them that my nephew had changed his mind and did not want to come to Ohio for this job. The PO then called my nephew and told him to call us and tell us to quit calling IDOC or else. (I can only imagine what the "or else" meant). He told my nephew that he was staying there, he was taking the job with his friend and that was final. I did find out from IDOC that there is absolutely nothing in my nephews file about any job opportunity here nor is there anything about Voc Rehab working with him. For information my nephew is current with all probation fees and restitution fees.

    Yes, this. Your nephew needs to get in touch with the PO's boss directly and get this sorted out.
