    Default Violation of Police Department Restraint Policy

    My question involves police conduct in the State of: CA
    Our PD uses Lexipol policy, however, time and again, they operate outside of these policies. In one case, ride-along hours are 10AM to 11PM. The cop has his girlfriend in the patrol car at 4AM. The policy manual says "we only use the Hobble restraint," but the victim was shackled. The policy manual cautions against forceful prone restraint, but the M.E. notes "history of placing the decedent in the prone position with wrists handcuffed behind back while requiring restraint of posterior head and torso."

    Cities are liable for practices and policies. Is it possible they bought the Lexipol policy manual to wave around in federal court and reduce their liability and never intended to follow it's policies?

    What sort of federal court action do you believe they're gong to waive their manual around in?
    What are you trying to accomplish. If you are the injured restrained person, you might have some cause for action.
    I'm not sure what the girlfriend has to do with restraint.

    Most of this seems to be an internal affairs complaint type of thing if you are just a member of the community unhappy with the police force.
