    Default Collector calling about employer's debt

    My employer had an American Express Business account with several credit cards. Each card has the company name on it and the name of the individual that was to use it. In other words, my name and the company's name were both on the card. All purchases on my card were items that were resold to clients or supplies used for the business. My employer is disputing a number of charges on their Amex bill and has stopped making payments until those are resolved. No charges on my card are being disputed, however there is an outstanding balance showing on that card. A collection agency called me at my home and claimed that since my name was on the card that I am liable for the debt on my card if my employer does not pay and if Amex writes it off it will hit my credit report. Is this true? Can the collection agency and Amex come after me for debts of my employer in this way?

    Unfortunately, you can be in deep trouble. That is why I politely declined one of these cards on a prior job I had many years ago.

    I am skeptical of the collector's claim, although I would want to verify your situation under Texas law. Normally with a company credit card the only contract is between the lender and the company, the company names employees it wishes to have cards on its account, and the company is solely liable for any charges made by an employee.
