    Default Underage DUI, Probation Violation

    my question involves criminal law for the state of: ohio

    i was arrested back in 2003 for a dui/underage bac [.055]. my license was suspended for a year, 30 day suspended sentence, fines, and a weekend class. i was unable to pay for the fines or the class and as a result violated my probation... i didn't know how to take care of the situation so i just kept putting it off until i eventually forgot about it. last month i went to get my license reinstated and was informed of two warrants - one for not paying fines and one for probation violation. i'm trying to handle this the best way posible - i turned myself so i have no active warrants, and received two court dates. i paid all my fines in full so i do not have to attend my status hearing. next month i will have a probation violation hearing. i have already signed up to take the original 3 day program before the hearing in an attempt to fulfill the original conditions. i do have a public defender, but i'm still waiting to hear from them. i'm hoping to avoid any time in jail - any suggestions on anything else i should be doing? this is the only thing i have on my record - also, any thoughts on what to expect at the probation violation hearing?

    Violation hearing will not have a guarantee of your freedom. You put some things on hold for a long time and the court may not have the patience to allow for you to complete your conditions. You stand a grat chance of being incarcerated. They may be ready to get things over with. You really can't do too much now. You can try to initiate the programs that you should have done from your court order. Show how much you've managed to get done in this time, but it really may be a case of too little, too late.

    I think you may have misread... I will have taken and completed the courses before my court date and have already paid all my fines in full, thus fulfilling the terms of my original court order.

    But you haven't dealt with it at the time you were violated. If you had done so in a timely fashion you would not have been violated. If you have done so by now, you have a pretty good chance to get off, but if the judge is pissed he could put you in jail.

    Exactly. I understand you fine. 2003- 2011. I don't think your order gave you that much time. You only needed a 3 day program to fulfill your obligation and it took you 8 years to do it. If the judge takes it, consider yourself blessed!
