    Default Juvenile Assault on Law Enforcement Officer and Resisting Arrest Without Violence

    My question involves a background check in the State of: Florida
    I was arrested as a juvenile for misdemeanor assualt on a l.e.o and misdemeanor resisting arrest w/o violence 11 years ago. can i become a firefighter? it was thrown out in court. rightfully so cause cop lied on me.no other arrest as an adult. so can i become a firefighter.

    While many, if not most, employers focus singularly on convictions when undertaking background checks, some public safety agencies do look at arrests as well as convictions.

    You should look at the websites for the fire departments you are considering. The websites should disclose what the job requirements are concerning criminal records.

    In addition, it is my understanding that the State of Florida precludes public employers from discriminating against applicants due to their criminal history. Considering you were never convicted of these charges, it would appear to contravene this state anti-discrimination law to preclude you from becoming a firefighter due to a juvenile arrest record.

    If the department will not hire individuals with juvenile arrest records, you may want to speak with an attorney to explore (1) whether such a restriction violates the aforementioned state law and (2) whether you can have your record expunged.
