    Default Entering Canada After Being Deported from the U.S.

    Hi,

    I would like to know if my deported Indian student friend (was on F1 visa earlier in USA) with 5 years ban, can try to get Canadian Student Permit to pursue his Masters from Canada. Will there be any affect because of ban in force in USA?

    History:
    He entered USA legally to study. His University was Shut down. He was out of status. ICE called for an interview and arrested though there was no criminal background. He opted for Voluntary departure in the court. At the time of exiting USA, they did not stamp anything on his passport and told that he can re-enter on the same visa. This poor boy tried to re-enter after a month on the same visa (which was not stamped) with the new admission letter, after consulting a lawyer!
    He was denied entry at the airport, CBP officer charged him with unlawful entery and imposed 5 years ban and stamped on his visa. When he protested on stamping, CBP officer advised him to change his passport in the home country, which is very illegal even in his home country!
    I know he is innocent with lot of dreams. He still wants to pursue his degree from a western country. He has planned to continue his degree from Canada. But I fear if Canada and USA shares database, would possibly pop up his previous record.
    Please advice with authenticity. Sorry if you feel offended, I am saying so because last time he consulted a lawyer, he was wrongly advised.

    Whether or not he qualifies for a student visa in Canada is something he would address in a Canadian forum or with Canadian immigration authorities. A F-1 Visa from the U.S. doesn't have any value for entry into Canada - he needs a visa for Canada.

    Hi Mr. Knowitall,

    I appreciate your quick response. But my question is with all this in his past, will it affect in anyway to get a Canadian Student Permit Visa. Will USA and Canada share any kind of information regarding their visitors, will Canada can access any kind of immigration records from USA.
    Also imagine he qualifies for a visa & gets it (as he did qualify for US visa because of his strong Professional Experience and Academics), will he be barred entry at the point of entry of Canada (when he gives his finger prints at the POE).
    And also suggest what should he mention in the visa application form against the question "Did you visit any country in the past" if he says yes then they will certainly ask him to provide PCC (Police verification certificate) from USA which is hard to get as he is in India now. Should he say no in order to avoid additional questions and information???
    Please answer these question, I appreciate once again...

    He should answer all questions truthfully.
    The fact that there is any discussion about misrepresenting his situation in order to obtain entry into any country is an indication that something is improper with his intentions.
