    Default Suing for Injuries After Harassing Behaviors

    My question involves injury or loss that occurred in the state of: Missouri

    A man was upset because he was trying to trying to keep a girls attention at a get together, she shot him down, and he began to harass and verbally abuse her invoking very personal issues, including bringing up one of her ex boyfriends that recently committed suicide. The girl told him three times to leave her alone and drop the subject, and the third time she made it very clear that he was crossing the line. There were two witnesses, both telling him to stop harassing her, including the owner of the house. The girl gave him one final warning, and told him that if he didn't stop that she was going to "slap the S*** out of him". He continued to harass her, she slapped him, and then he hit her back. At that point the two other people tried to diffuse the situation, and the owner of the house asked him to leave. He continued to run his mouth, and the girl who was being pulled away grabbed a glass, threw it at him, and nailed him in the forehead. Both parties left, and the man ended up going to the emergency room to get nine stitches. He is now threatening to sue for the medical bills.

    The guy is a real dbag, and it was obvious that the girl was gradually being pushed into a fit of rage, and that the man was set out to provoke a response. I'm just wondering if any of this will matter in court considering she started the physical violence, and threw the glass while people were trying to diffuse the situation.

    You've not indicated that her actions were in self-defense, so she may well end up having to pay the bill for the injury she inflicted.

    She is liable. No matter how much of dbag he is. She did it plain and simple. Regardless. Self defense does not include stopping someone from talking to you.
