    Default Want to Immigration Based on Remarriage, But Possibly Not Divorced

    In 1992 I was married in California to a U.S. Citizen. I am from England. Due to irreconcilable differences we split-up in 1995. My ex informed me in 1997 that we were divorced. I never received any paper work or confirmation regarding the divorce. Because of his stalking behavior I accepted it at his word. Consequently I re-married in 2001. Having just returned to the U.S. I want to obtain my Green Card with current husband and cannot locate my divorce papers. Is this a problem? Should I or could I re-divorce and re-marry. Have I broken any laws?

    If you "never received any paper work or confirmation regarding the divorce", should we infer that by "cannot locate my divorce papers" you're talking about trying to find them through a court?

    Information on county offices through which you might be able to get copies of a California divorce can be found here. It is possible that you're still married to your first spouse and that your present marriage is not valid. If you cannot document a divorce, I suggest discussing your strategy for divorce and legitimizing your current marriage with an immigration lawyer.
