My question involves paternity law for the State of: California
About six weeks ago I was told that I had fathered a son 16 years ago. When the child was born the mother was dating another man and not married to him. That man signed a birth certificate. I was not told about the conception or the birth. Now that I know, I want to be a part of the child's life. I'm aware that in California once you take responsibility you become the father. Seeing as I wasn't given a chance at birth I would like to start now. With all the texting evidence that I have and Facebook posts do I have the right to request a DNA test to the courts? If the test is positive to have the right to change the name on the birth certificate? I know that a child born into the marriage is considered a product of that marriage but since they were married is there a loophole that will allow me to gain some rights? Is it against the law to sign up for certificate if you are not the father? Even though I'm sure he didn't know. Any helpful advice would be appreciated. Thank you.
