    Question What Sex Offender Registration Laws Apply After You Move

    My question involves criminal law for the state of: Idaho/Pennsylvania

    After a fair amount of research, I'm having a hard time finding a specific answer. I'll be happy to provide any additional details if needed.

    Statutory rape offense in Idaho, 6 years probation, which ran into when Idaho passed their registration law. Registered. After probation was completed, moved to Pennsylvania. Resistered there, and designated 10 year registrant, though listed under a worse offense, as it didn't have an exact match for the offense. Some time later original offense reduced to generic misdemeanor in the original jurisdiction. After more time passed, reached the 10 years with no problems and received notice in writing from PA that the registration requirement had expired, and was removed from the PA website.

    Given that the registration laws are not an exact match, can there be any potential problems? Has the registration requirement only been lifted in PA? It is about 20 years since being placed on probation.

    When you are on probation you must comply with the terms of your probation wherever you live. Subsequently you must comply with the sex offender registration laws of the jurisdiction where you live. If you move to another state, you may be required to register even if you were no longer required to do so in the state in which you were living. There may be jurisdictions that require you to register based upon a substantial presence short of domicile; laws are different in each state.

    Thank you. A little more specifc background. Idaho law allows a motion to be removed from registration at 10 years. However the standard required to do so was proof of absolutely no risk to reoffend, and nobody was. Recently the Idaho Supreme Court ruled that the standard was not as strict as was being applied (http://law.justia.com/cases/idaho/su...8/kimball.html). However, despite wining the case, the person bringing the case is still registered, and as far as I'm aware, Idaho has never released anybody from registration requirements.

    A friend of mine who is a lawyer (not criminal law, and doesn't practice in either ID or PA), is concerned that even if PA has ended their requirement to register, that Idaho may still require my registration, and be able to impose criminal sanctions if PA doesn't keep me registered. I haven't lived in Idaho for more than a decade, and have no property, or residence, and only visit for a few days at at time every 4-5 years, and haven't been listed on Idaho's registry since I moved out of state.

    From what you said, as long I remain in PA, and don't violate any laws, I shouldn't need to worry about being forced to go back on the registry, correct?

    From what you said, as long I remain in PA, and don't violate any laws, I shouldn't need to worry about being forced to go back on the registry, correct?
    Correct.

    You don't live in Idaho any more, so Idaho no longer has jurisdiction. Keep your nose shiny, and you'll be fine.
