    Default Can You Determine Car Accident Fault from Damage Alone

    My question involves an injury that occurred in the state of: IL

    Can you determine fault in a car accident by looking at the damage alone?

    I was in a car accident on the 4th. I was approaching an intersection in the left turn lane (the light was green with no arrow and we were in a downtown area so we were going slow). A car in the lane to the right of us decided to merge into the turn lane when we were right next to her. We must have been right in her blind spot. She is telling her insurance company the accident happened in a different way to avoid fault. Her damage was above the drivers side wheel and the rim of the wheel. Mine is to my whole passengers side fender, wheel well, rim, and passengers side door (no longer opens all the way). My alignment was also knocked out of wack. The extent of my damage is far worse than hers is.

    We called the police at the scene and even the officer told her from our story it sounded like it was her fault. I really just don't want to get screwed over and stuck with a car that I can't afford to fix. My insurance would fix it, but I don't have an extra $500 laying around for the deductible and I shouldn't have to pay a dime either way when it wasn't my fault.

    Damage can give an impression of how an accident occurred, sometimes better than other times, but any investigator is going to want to see both cars and will very much prefer to see the accident scene before it's cleaned up (preferably with the cars in post-accident position). If you can't afford $500 for the deductible, you also can't afford an accident reconstruction expert.
