    Default Filing Taxes as Single Before Applying for Citizenship

    I am preparing my application for citizenship. I got married in 2008 outside the uSA, my husband doesnt lieve in the usa and I have file my taxes as single. Could the fact that I did not file as married filling separetely be a problem in my citizenship interview and/or application?

    If you're not living with your husband, and not even marking on your tax return that you're married filing separately as opposed to single, you're creating both a pattern of conduct and a paper trail that might cause the USCIS to question the validity of your marriage. I suggest that you consult an immigration lawyer with the details of your case.

    Not only can it be a problem with the CIS, it can be a problem with the IRS. You should NOT have been falsifying your tax returns. Even if the spouse is living abroad, if you were married on the last day of the tax year, you must file in one of the married (jointly or separately) status.

    Consider talking to an accountant about preparing and filing amended returns.
