My question involves real estate located in the State of: Maryland
My trees and shrubs have been in place for more than three years. The HOA has never said anything to me now they are insisting that I cut them back. In my front yard I work with my neighbors to ensure that they are not annoyed with my tree limbs. In the back yard my tree limbs have grown over the fence. Over the fence is the common alley, so they are not in anyone's yard, they are in the air. I have been told that if the HOA has not said anything within three years they cannot do anything. My question is the property line reserved to the ground or does in also include air space? Can my HOA make me trim my trees if they have been in the same condition for over six years? Thank you.
