    Exclamation Negotiating with Collections

    My question involves collection proceedings in the State of: Iowa

    I received a collections notice in the amount of $3,800 from a parking lot accident where I was determined to be at fault by the other party's insurance co. Their subrogations claims adjuster agreed that there may have been contributory negligence against their insured but since I did not have insurance at the time (it had lapsed) that I was automatically liable for her damages and that it was being turned over to collections and that I would have to negotiate with them. I need to come up with a payment agrangement soon in order to keep my car licensed. Do you think the collections co will work with me and reduce the amount by 1/2 or my percentage of fault or should I just expect to pay the entire amount?

    Being uninsured does not make you automatically liable for the other driver's damage.

    If you want to try to negotiate a payoff for less than the total amount claimed, contact the collection agency and try to negotiate the reduced payoff. Make sure that you have an agreement in writing before you send off any settlement check.

    I went back to the subro dept and advised them that just because I did not have insurance at the time of the accident that they could not make me automatically 100% liable and after stating the facts of how there was comparative negliance and if I had to I would file for my vehicles damages in small claims court, they instantly wanted to settle at 50% of the amount they were requesting me to pay and will even work with me on making payments to them. I will make sure I get everything in writing before sending them money. Thanks for your help!
