    Default Will a Victim Be Informed of a Dismissal

    My question involves criminal law for the state of: California

    I have two scenarios but one question.

    1. Suppose I'm a victim of assault and battery, and the case is dismissed at some point before trial...what rights do I have as a plaintiff in terms of being informed of the dismissal?

    2. What about a different case involving DV, is there any requirement for the court to inform the plaintiff that the case was dropped?

    You're not the plaintiff in a criminal case. You're the alleged victim. Prosecutor's offices can be expected to keep victims informed of the status of a prosecution.

    As Bullwinkle says, it is the STATE that is the bringing the case (the plaintiff if you will) not you. Many jurisdictions have victims advocates that can help keep you informed of the case progress.

    Just FYI on this...I just came back a few years later checking all the threads I started. I was a DV victim but I was on the wrong side...see I was a male that was with a woman that turned out to be more than just violent. She did these things because I made it clear from the beginning that I didnt hit women. After the first cops showed up I got mail addressed to me from victim service group which looked like it was tied to the courts. I called them and they yelled at me over the phone that they would not be giving me any information. I was merely calling asking what they were about and why they sent this thing to me (I didnt even know that men could be victims of abuse I didnt see myself as one yet). After my initial bewilderment about why this thing was sent to me and why I was being talked down to so rudely over the phone, I realized they thought I was the abuser because I'm a man. They thought I was some abusive jealous husband calling about my poor lil victim. At that point I just lost it (it was the day after the incident) and I scolded the woman on the phone and I told her I was on the other end of the fist and the hammer and at one time a knife. It was a cold hard wakeup call literally. Just FYI to anyone else that is in those shoes. Its been many years and I'm far from that situation now. Never had another female like that in my life and never will. If I actually got some help and understanding, the whole thing would have ended smoother. But instead I stayed because I made excuses for her, and in the end it got so bad that I did something that I regret till today. Luckily I had a good lawyer that got me immunity in exchange for certain information.

    you have no "right" to be informed in either; as a courtesy, most DA/SA will give you a call but they are not mandated by law to do so.
