My question involves a traffic ticket from the state of: Washington
I am a Canadian Citizen who received a speeding ticket in Bellingham while shopping
Date of Violation was march 12, 2011
Required to respond within 15 days
I mailed in request for contested hearing
Never heard back from them until June 7, 2011-sent me a notice of suspension of driving priviledges in the state of Washington b/c I failed to respond to the citation
A few days after receipt of this, I personally went to the courthouse and dropped off a letter explaining that I had responded and requested for a contested hearing. clearly there was some mixup with the paperwork, and I asked that this letter be used as request for contested hearing
Got a response a few weeks later that a hearing date was set for Sept 6, 2011
My question is-this date of the hearing (Sept 6) is more than 120 days after the notice of infraction (march 12)
Can I write them asking for a motion to dismiss and cite the below law?
OR is it 120 days after they responded to my letter in june???
