    Default Jurisdiction for Child Support

    My question involves a child custody case from the State of: VA

    A little over a year ago, my child lived with her mother in Town A. I filed for custody in town A where they lived at the time. Mother and child moved to Town B shortly after I filed but before the trial. Judge in Town A ruled in my favor and child came to live with me 10 months ago. I live in Town C. Mother appealed original court decision, which was heard about a month ago in Town A. Decision of lower court upheld, more detailed order written, and case remanded back to lower court for anything further.

    Child still lives with me in Town C. I want to file for child support, but do not know whether to do so in Town B, where the custody/visitation order was written, or in my town C where child has lived for 10 months.

    The court that issued the most recent custody and order has continuing jurisdiction. If you want to file elsewhere you are going to have to convince the court to transfer venue.
