If you and dad both agree to the name change, you petition for the name change, follow proper procedures for publicizing the petition, and have a court hearing on the petition - with everybody in agreement, it would be very likely that the name change would be approved. Forms are here.

So we would just fill out that form and take it to a court , do you know how much it would be ? And would he get a new social ?

No, you have to send the court order to the SSA and get the name changed on his records there. The filing fee is around $200. You should also expect to pay a few bucks for getting the forms notarized and getting additional certified copies of the order you may have to send to the SSA, insurance companies, and the like to get them to change their records.

Just to clarify - it doesn't actually cost anything to change the name on the social security card. All that's needed is a certified copy of the court order.
