My question involves criminal law for the state of: MA
My friend was involved in an incident in a parking lot this weekend. A driver was speeding going the wrong way and nearly ran him over. He yelled and told him to slow down. The driver pulled over and was very arrogant about it. Words were exchanged and he slapped the man across the face. Police were called and statements made. There were no witnesses but he admitted to striking the man. The driver is filing an A/B complaint. I told him he should consult and attorney as soon as he receives something in the mail. He has no prior record and says that he felt very threatened by the way the man was driving. Says it scared him like having a gun pointed at him. Can he sue based on the way this person was driving? What typically happens given the circumstances?
