    Default Applying for a Green Card While Temporarily Living Apart

    Hello, Im an American citizen and me and my boyfriend(who is here with a student visa) want to get married (we've been together almost a year, lived together for 6 months). I've been doing alot of research on the whole process and I understand all the paperwork we have to go through. The problem is I will be leaving in september to do study abroad for 10 months, although I will come back every chance I get to visit, I will have a 2 month break from school so I will come back then. Of course we want to apply so my boyfriend can get his green card but it would be during the time I am abroad. If we get an interview then I would plan on coming back to the US for that time or try and schedule with the immigration office to work somthing out (can you schedule your appointment or do you have to go when they tell you to?) but will me temporarily living abroad hurt our chances? I plan on keeping my permanent address with the appartment I share with my boyfriend and we have joint bank accounts and stuff. Should we just be honest with the immigration office and tell them that I am doing study abroad or just not talk about it? I dont know....Im just scared because of all the stuff I read about how hard it is because of all the people who apply for fake marriges.

    I know we could wait but with his visa if he leaves the country it will be very hard for him to get a re-entry visa, and I want him to be able to visit me while im abroad and travel together to go visit his family.

    If you're not living with your spouse, that can raise questions about whether you actually have a bona fide marriage. The USCIS knows that sometimes spouses can end up living apart. It also knows that a lot of spouses who live apart are not actually in bona fide marriages and are attempting to game the system. So at a minimum you can expect more questions and scrutiny. If you cannot make the appointment scheduled for you, you can attempt to reschedule.

    If he wants to travel after petitioning to adjust his status but before the petition is approved, he should apply for advance parole.

    You should always be honest with the USCIS.
