    Default Sued by a Furniture Rent to Own Store

    My question involves collection proceedings in the State of: OHIO

    Husband and myself went to get a new bed- 1200.00 total, i did not work and he was a student at the time - big sandy furniture agreed to rent us the bed monthly at 112.00 using our only income as financial aid from school loans, i was a co-applicant. husband made 4 payments, and then got kicked out of school for grades. could not continue paying on bed, they would not let us pay 10.00 monthly which was all we could afford at the time, got letters on aug.3rd.2011- small claims court for balance of 753.00 ,it also said if we do not appear our wages will be garnished. we rented the bed in feb.11- stopped paying in may 2011. we are no longer together and he took the bed (along with many of my things-nasty situation)



    if i go to court that day can i be arrested for not returning the property even though i no longer have it? if i dont go to court will they put out a warrant for me? if i go to court and my husband doesnt show up will they put the whole balance on me? would they let me do some kind of payment plan if i do go to court? any advice would be greatly appreciated



    i have posted all the facts that are all sad yes but true, i understand people make bad decisions all the time, and this looks horrible on me and my character, but i just want some answers, i appreciate it, i do want to go to court and not have to worry about a garnishment when i start my new job, i just want to get this all over with- but i want to be prepared atleast.

    i highly doubt my husband will be tat court, seeing how his court papers were mailed here to my house and he wont return my calls to let him know

    A civil lawsuit is not a criminal case. You've given us no information suggesting that you've been criminally charged.

    If you blow off the court date you can expect a default judgment to be entered against you.
