    Unhappy Rules of Eviction

    My question involves an eviction in the state of: Oklahoma

    I have no lease I pay month to month. Can my landlord evict me without written notice?
    Also, I have paid rent up to sept 2, she wants me out sept 5th, do I get 30 days starting Sept 2? Or starting now?

    In most states, month to month leases require a 30 day WRITTEN NOTICE, Year leases require 60 days.

    You will have to check with your COUNTY CLERK to find out about the laws in your COUNTY. Eviction involves the County Civil Court. Do a Google (I prefer WWW.DOGPILE.COM) internet search. Put the name of your county followed by the word "clerk". In my county I search for "brevard clerk"

    When I do that search it helps me find the laws for my county, the clerk posts them online. You will have to READ and RESEARCH to learn the laws in your particular area.

    But I digress.

    If you paid the rent up to Sept 2, (don't rely on words in your lease, you may be misinterpreting them) and your landlord has not sent you a WRITTEN notice, such as a 30 day notice required in Florida ( see your own states rules) you need to send a certified letter to your landlord notifying them of your state laws and telling them when exactly your state laws allow them to ask you to move out.

    I am assuming you are CURRENT on your rent. If not, pay your rent, and keep WRITTEN receipts. If you already received a county notice you may need to pay into the CLERK OF COURT, make no mistake, read the paperwork.
    Read and learn the laws of your state, use internet searches.
    No landlord can evict anyone without following the laws of your state/county. It is very complicated and if you have a strong case (as you appear to) you should hire a lawyer and when you win the losing party will have to pay for your lawyer.
