My question involves a foreclosure in the State of: New Hampshire
Seller agent caught in several lies. Most recent trying to get copy of a septic design that foreclosing bank ordered. House on market 200+ days probably b/c 4bdrm house and septic for 2bdrm. Question of marshland and if okay to upgrade. Original septic never legally done and time for new anyhow. Agent said designer not done w/septic design cannot give to us. I contacted designer personally they said it's been complete and agent can pick up anytime. Agent (claims) waiting for designer to file with state for approval and will not give to us until AFTER we close. Designer said they do not file and is responsibility of agent/bank what they want to do with design. We suspect problem that agent doesn't want to disclose.
Does seller agent have to disclose this PRIOR to sale or can they allow designer to keep to avoid disclosing at all?
