    Default Enforcing Visitation After Interstate Relocation

    My question involves a child custody case from the State of: Nv

    My husband took his ex wife to court, she was trying to move and take their child to a different state withOUT permission from the courts. My husband proved proof the child had family,friends in our town. And the only reason she had for wanting to move out of state was that she was getting married. No because she had a job or anything like that, just simply because she was getting married. Anyways, we have proof that she's an unfit parent (for example: she would drop their child off at a friends and leave for days/weeks and not have any kind of contact with the child) and that their child knew our town. But the judge let her move with the condition that they switched off every other holiday, my hubby got their child every summer, and that they had to meet each other 1/2 way. Well this past summer my hubby called his ex wife to see what her plans were to meeting him in the spot they were to meet and she told him she could not meet him because her car was repoed...is that considered contemp? And what should my husband do? we do NOT have a lawyer

    Evidently Mom is NOT legally unfit - your husband needs to let that one go.

    Has your husband turned up to collect the child? Is there any reason he can't simply pick up kiddo from Mom's? Negotiate something?

    He can file for contempt if he wishes, but nothing is likely to happen for a first time. And if Mom has a genuine reason - no transportation, for example - she is not likely to be held in contempt.

    Contempt must be WILLFUL.

    My hubby would drive all the way to her but she moves to a different place week to week. Never can keep track were they are living (never gives us her address). His son calls once in awhile and tells his dad they have moved but his mom won't let him give his dad his address.

    And this isn't the first time she's not showed up.

    Ok seriously, she moves EVERY WEEK? How does Dad know this? How old is the child?

    His son is 11

    Not every week, but it sure seems like it, every other time my stepson calls they have just moved or are moving. She can't afford rent.
