    Default When Do You Have to Tell Your Employer You're Quitting for a New Job

    My question involves labor and employment law for the state of: California

    I have a job offer w/ the starting date in 2 months.

    My question is: if I accept the offer, when must I notify my current employer?

    In other words, are there any legal implications of accepting the offer and NOT notifying my current employer until say 2 weeks before the starting date?

    A side note, the potential new company competes w/ a different area of my current employer (not directly my area, though).

    There are no laws requiring you to give the employer any particular notice. If your new job starts (as an example) Wednesday, you could say on your way out the door of your last job on Tuesday, "Oh, by the way, I quit - I won't be in tomorrow" and as far as the law is concerned, you would have violated no laws.

    However, the flip side of that coin is that no-notice-required works both ways. Your employer would be within his rights, if called for a reference then or in the future, to mention that you walked out with no notice and left them in the lurch. Additionally, if you go to your employer and say, "I've found a new job and my last day will be two weeks from tomorrow", they are free to say, "No it won't - your last day is today. Pack your things and don't let the door hit you on the way out".

    Thanks so much for the prompt reply. Very much appreciated. I'd surely give them at least 2 weeks of notice, and I'm aware they may not want to take them.

    My question (which I think I was not able to articulate very well :-) ) was: given that I'd have to wait around 8 weeks, is it ok to accept an offer and not to notify my current employer for 6 weeks. From your reply, it seems it would be ok.

    Yes, it would be ok. No one knows what your employer might do though if they find out before then that you have another job offer.

    There are simply no laws that address this situation. You are under no legal obligation to tell them immediately upon being offered another job, or to give any particular length of notice. It is just not a legal issue.
