Court costs and fines. Civil Demand. Criminal Record. Possible community service or anti shoplifting class, at his expense. I hope that underwear was worth it....it will cost him over $1000.
criminal conversion, at this level, is a class A misdemeanor.
the possible penalty is as follows:IC 35-43-4-3
Conversion
Sec. 3. (a) A person who knowingly or intentionally exerts unauthorized control over property of another person commits criminal conversion, a Class A misdemeanor.
Then toss another $1k-$1.5k for a lawyer.IC 35-50-3-2
Class A misdemeanor
Sec. 2. A person who commits a Class A misdemeanor shall be imprisoned for a fixed term of not more than one (1) year; in addition, he may be fined not more than five thousand dollars ($5,000).
If he can't afford to pay for a package of underwear, I would suggest he can't afford a private attorney. Probably will need a public defender.
