    Default Can Friend Be Charged With Domestic Violence

    My question involves criminal law for the state of: MD....Two girls friend had a fight no seriuos injury...only black and blue markes no blood no cuts no first aid needed they charged them with 2nd degree assault. They are not related nor are bi sexual true friends only. I think they are charged wrong. They are not pressing charges. Also 3rd friend(female) was trying to break it up was charged the same crimes, she was never hit nor hit anyone. It started in a cab ended in the street. They went to their hotel room and were yelling only when the police came. The police interview the cab driver and hotel clerk. I think it was/is mutual combat under md law.

    Why does everyone think that there has to be injuries? There DON'T. Injuries are irrelevent to the charge itself - the presence of injuries typically only serves to increase the LEVEL of the crime. Maryland re-vamped their assault/battery/DV statutes in recent years, and ANY two people in a physical altercation are going to be charged with assault, the DV aspect only serves to "kick" the charge up a notch.
